Holding the municipality liable
If you have suffered damage(s) and believe that the municipality is liable for it, you can report your damage online.
How does it work?
Conditions:
- The damage(s) suffered is due to the municipality.
- The municipality has not complied with a written or unwritten legal rule.
- There is a direct link between the culpable act or omission of the municipality and the damage you have suffered.
- Incomplete damage reports will not be processed by the municipality.
- In case of damage(s) due to the condition of roads, paths, and sidewalks, the municipality is only liable if the road is dangerous or defective and this can be blamed on the municipality. There can always be small irregularities or differences in height.
What should I do?
You can only submit a claim to the municipality online.
- Fill in the online digital liability form. It is important that you substantiate the liability well.
- Overview photo and detailed photo of the damage
- Well-specified damage note or estimate
- Original purchase note of the damaged item
- For cars: expert report from a recognized garage
- Situation sketch, if applicable
- Police report, if applicable
- Witness statement, if applicable
- If necessary, the municipality can ask for additional data.
How long does it take?
The processing time is 8 weeks.
